要
建立中国有特色的社会主义市场经济体系， 法制建设是关键。
社会保险制度建设是法制建设的重要组成部分, 其完善与否， 关系到社会秩序的稳定和经济的良性发展以及社会的全面进步。
我国社会保险制度除了具备社会保险制度的一般特征， 如基本保障性、 国家强制性、互助互济性、 主体特定性、 待遇差别性、 国家补偿性、 社会福利性外， 尚有自身的特点。
产生这些特点的原因是多方面的, 我国社会保险制度立法滞后以及立法层次偏低， 使得社会保险制度的强制力度不足是最主要的。
要改变我国目前社会保险制度存在缺陷的现状， 必须既要借鉴发达国家的一些成功经验, 又要根据我国的具体情况, 进一步完善与健全社会保险法律制度, 真正使这种良好的法律制度“造福于民， 惠及子孙” 。

To establish a socialist market economic system with Chinese characteristics, the point is the building of the legal system. The building of social insurance system is the important part of the building of the legal system, whether it is perfect is important to the stability of social order, the benign development of economy and the comprehensive progress of social. The social insurance system of our country does not only have the general characteristics, like the basic
security, the mandatory by the country, the helpfuless for each other,
the main specificity, the differencese of treatment. the compensation of the country, the social welfare, but also has it’ s own characteristics. The reasons of it are many, the legislation of our country’ s ocial insurance system is lag and the level of the legislation is low. these made the degree of the mandatory in social insurance system is not enough, and this becomes the main problem. In order to change the status that the currently social insurance system of our country has got some flaws, we must learn the successful experience from the developed countries,
meanwhile,
according to the specific circumstances of our country, we should do something further to make the legal system of social insurance more prefect and complete, really make this good legal system brings benefits to the people.
